Welcome to Vrchatz LTD. These Terms of Use ("Terms") govern your access to and use of the website located at https://vrchatz.com (the "Site") and the booking of any travel packages, self-drive tours, and related services offered through our platform. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.

1. Acceptance of Terms and Eligibility

By using our Site, you represent that you are at least 18 years of age and possess the legal authority to enter into a binding contract. If you are booking on behalf of a group, you represent that you have the authority to bind all members of your party to these Terms. We reserve the right to refuse service, modify itineraries, or cancel bookings for any reason, including but not limited to violations of these Terms.

2. Bookings, Payments, and Cancellations

All tour prices are quoted in Canadian Dollars (CAD) unless otherwise specified. A non-refundable deposit is required to secure your booking and initiate the reservation process with our suppliers (hotels, car rental agencies, etc.). The remaining balance is typically due 60 days prior to the commencement of your tour. Cancellation fees vary depending on the timing of the cancellation and the specific policies of our third-party suppliers. We strongly recommend purchasing comprehensive travel insurance at the time of booking to protect your investment against unforeseen circumstances.

3. Self-Drive Tour Specific Conditions

Our self-drive packages include the use of a rental vehicle. The primary driver must meet the minimum age requirements set by the rental car provider (usually 21 or 25 years of age, depending on the vehicle class and province). The driver must possess a valid driver's license held for at least 12 months. International visitors must carry an International Driving Permit (IDP) alongside their domestic license. You are solely responsible for adhering to all local traffic laws, parking regulations, and toll payments. Any fines, traffic violations, or damage to the rental vehicle incurred during your trip are your sole responsibility and will be charged to the credit card provided to the rental agency.

4. Intellectual Property Rights

All content included on this Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, as well as the custom itineraries and travel guides we provide, is the property of Vrchatz LTD or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, modify, display, or use any content from this Site without our prior written consent.

5. Limitation of Liability

Vrchatz LTD acts as an intermediary between you and the various travel suppliers (airlines, hotels, car rental companies, tour operators). We are not responsible for the acts, omissions, errors, representations, warranties, breaches, or negligence of any such suppliers or for any other damages, losses, or injuries resulting therefrom. Our liability is strictly limited to the amount paid by you for the specific service or tour package in question. We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of income, travel delays, or missed connections due to weather, strikes, or mechanical failures.

6. Force Majeure

Vrchatz LTD shall not be held liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, extreme weather conditions, natural disasters, pandemics, government restrictions, strikes, civil unrest, or supplier bankruptcies. In such events, we will make reasonable efforts to assist you in modifying your itinerary, but additional costs incurred will be your responsibility.

7. Indemnification

You agree to defend, indemnify, and hold harmless Vrchatz LTD, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of another party.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario. You consent to the jurisdiction of such courts and waive any objections to the venue.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. All changes will be effective immediately upon posting to the Site. Your continued use of the Site following the posting of changes constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically to ensure you are aware of the most current version.
